BFM's Statement on Allegations of Sexual Harassment

 

 

BFM MEDIA STATEMENT — 7th January 2019

 

BFM would like to provide an update on allegations made in an anonymous letter which was circulated in December 2018.

The independent investigating committee, comprising independent lawyers, submitted its report to a board panel comprising current and former non-executive independent directors of BFM (the “Board”) late last week. The Board has met and communicated its decisions to the BFM management team.

The findings of the investigating committee highlight the following:

· Where the rape/sexual assault allegation is concerned, the BFM management team was first made aware of this allegation in May 2017. Immediately upon receiving the complaint, the BFM management team commenced an investigation and took the highest form of disciplinary action by terminating the employment of the accused employee. The BFM management team did not make a police report as the complainant did not wish to escalate the matter at the time.

· In respect of the allegations of sexual harassment, two employees have been served termination letters for misconduct. The Board has determined that there is sufficient evidence to warrant this course of action. The BFM management team acknowledges that more could have been done to proactively gather evidence so that such misconduct could have been addressed in a more timely manner.

Following the recommendations of the Board, the BFM management team is committed to improving its structure for employees to report any grievances they may have. Complaints will be handled impartially, and it is our intention to have this structure in place within four weeks.

A review of BFM’s existing internal policies and guidelines is also underway. Our goal is to ensure that our employees feel assured that they work in a safe environment. As part of this review, we will be instituting training and awareness programs for all employees; these will clearly lay out the parameters of acceptable and unacceptable conduct in the workplace, and the consequences for transgressions.

We continue to strive to create a workplace where everyone who works at, and with, BFM, regardless of their gender, feels safe and empowered.

BFM MEDIA STATEMENT — 7th December 2018

 

BFM would like to respond further to the allegations and information that has been circulating on social media. We want to reassure both our listeners and staff members of the transparency in our approach to these allegations and seriousness with which we are treating them.

An independent investigating committee is now handling the allegations. This committee comprises lawyers who were appointed due to their experience and expertise in matters relating to sexual harassment cases.

This investigating committee is entirely independent of the BFM management team and has been given a full mandate to investigate all of the allegations contained in the anonymous letter. It reports directly to a board panel consisting of independent non-executive directors of BFM.

Staff at BFM have been given direct access to the investigating committee without any need to go through any management team members or supervisors.

We welcome these findings and look forward to strengthening our social and reporting structures to better serve the needs of our staff, the people who have built BFM into an incredible institution it is today.

BFM is committed to being open. We know that the public holds us to a high standard of accountability. We have to meet that challenge and requirement. We take all allegations made by members of staff with the utmost seriousness. We strive to create a workplace where every member of staff, regardless of their gender, feels safe and empowered.

BFM MEDIA STATEMENT — 3rd December 2018

 

The current allegations circulating are upsetting and distressing for all of us at the radio station. Our first priority is and has always been the welfare of our employees and we take any and all allegations of sexual harassment and misconduct seriously.

We have started formal investigations and we are engaging with those that have been named. Some of the employees involved have taken a leave of absence. We will also be appointing an independent party to assist us in conducting an impartial investigation.

Since the formal investigative process is underway, there are restrictions on what we can publicly announce during the proceedings. Until more information comes to light, we do not wish to make statements that may compromise the investigation and cause further distress to our staff.

We would like to address an email currently in circulation that alleges sexual harassment at BFM89.9.

We are committed to providing a safe environment in which all members of our community can work without fear and threat of sexual harassment.

At this juncture, we are unable to confirm any of the situations described.

We take all allegations of sexual harassment and misconduct seriously. Internal investigations are initiated whenever an allegation is made. Our practice has been to offer employees discretion and fairness, and we take action when we learn of unacceptable behavior.

As an added precaution, we are reviewing our reporting mechanisms to ensure continued access to safe channels for these serious matters to be escalated and dealt with. And we continue to look for ways to improve our workplace to support and protect any member who comes forward with information or allegations about misconduct.

Kenyataan Media BFM — 7 Januari 2019

 

BFM ingin mengeluarkan kenyataan lanjut berkenaan dakwaan yang dinyatakan dalam sebuah surat yang telah disebarkan pada Disember 2018.

Jawatankuasa Penyiasatan Bebas, yang terdiri daripada peguam bebas, telah menyerahkan laporannya kepada sebuah panel yang terdiri daripada ahli dan bekas ahli bukan-eksekutif lembaga pengarah BFM (“Lembaga Pengarah”) lewat minggu lepas. Mereka telah mengadakan pertemuan dan menyampaikan keputusan mereka kepada pihak pengurusan BFM.

Hasil penemuan jawatankuasa penyiasatan tersebut mendapati:

· Berkenaan dakwaan rogol/serangan seksual, pihak pengurusan BFM telah menerima aduan pada Mei 2017. Sejurus menerima aduan, pihak pengurusan BFM telah menjalankan siasatan dan mengambil tindakan disiplin yang tertinggi dengan menamatkan perkhidmatan pekerja yang tertuduh. Pihak pengurusan BFM tidak membuat laporan polis kerana pengadu tidak mahu melanjutkan perkara itu, pada masa tersebut.

· Berkenaan dakwaan gangguan seksual pula, dua pekerja telah diberikan surat tamat perkhidmatan, atas sebab salah laku. Lembaga Pengarah mendapati, wujud bukti yang mencukupi untuk mengambil tindakan ini. Pihak pengurusan BFM mengakui bahawa tindakan secara proaktif, untuk mengumpul bukti, sepatutnya dilaksanakan, agar salah laku ini boleh dikendalikan dengan lebih cepat.

Berikutan cadangan daripada Lembaga Pengarah, pihak pengurusan BFM kekal komited dalam memperbaik struktur kami untuk pekerja membuat aduan sekiranya terdapat sebarang perkara yang mengganggu mereka. Aduan akan dikendalikan secara telus, dan adalah niat kami untuk mewujudkan struktur ini dalam tempoh empat minggu akan datang.

Penilaian semula polisi dalaman BFM dan garis panduan sedia ada juga sedang dilaksanakan. Matlamat kami adalah untuk memastikan pekerja kami berasa selamat dalam persekitaran kerja kami. Sebagai sebahagian daripada penilaian semula ini, kami juga akan melaksanakan latihan dan program kesedaran untuk semua pekerja; diharapkan langkah ini akan dapat mengetengahkan, secara jelas, parameter kelakuan yang diterima dan tidak boleh diterima di tempat kerja, dan kesan sebarang salah laku.

Kami akan terus berusaha mewujudkan suasana tempat kerja yang selamat untuk semua orang yang bekerja dengan, atau bersama BFM, tanpa mengira jantina.

Kenyataan Media BFM — 7 Disember 2018

 

BFM ingin mengeluarkan kenyataan lanjut berkenaan dakwaan dan maklumat yang telah tersebar di media sosial. Sekali lagi, kami ingin memberi jaminan kepada pendengar dan pekerja kami tentang ketelusan pendekatan kami berhadapan dengan dakwaan-dakwaan ini.

Satu jawatankuasa penyiasatan bebas kini sedang mengendalikan dakwaan-dakwaan ini. Jawatankuasa ini terdiri daripada sekumpulan peguam yang dilantik berdasarkan pengalaman dan kepakaran mereka dalam hal-hal berkaitan kes gangguan seksual.

Jawatankuasa ini bebas sepenuhnya daripada pihak pengurusan BFM, dan telah diberikan mandat penuh untuk menyiasat kesemua dakwaan-dakwaan yang terkandung dalam surat yang disebarkan. Mereka kemudiannya akan melaporkan terus kepada satu panel bebas yang terdiri daripada pengarah bukan eksekutif di BFM.

Pekerja di BFM telah diberikan akses terus kepada jawatankuasa penyiasatan bebas ini tanpa perlu melalui pihak pengurusan atau penyelia mereka.

Kami mengalu-ngalukan hasil penemuan siasatan tersebut. Kami juga ingin mengukuhkan lagi struktur laporan dan struktur sosial kami, agar dapat memenuhi keperluan pekerja kami yang telah membantu membina BFM menjadi satu institusi yang berjaya.

BFM komited untuk bersifat terbuka. Kami sedar bahawa orang awam meletakkan standard akauntabiliti yang tinggi terhadap kami. Kami perlu memenuhi standard tersebut. Ini termasuklah mengambil setiap dakwaan yang dibuat oleh pekerja kami dengan penuh serius. Kami akan terus berusaha untuk mewujudkan satu suasana tempat kerja di mana setiap pekerja, tanpa mengira jantina, akan rasa selamat.

Dakwaan yang telah tersebar baru-baru ini adalah amat mengecewakan dan mendukacitakan buat kami semua di stesen radio ini. Keutamaan kami adalah untuk sentiasa menjaga kebajikan pekerja-pekerja kami, dan kami mangambil semua dakwaan gangguan seksual dan salah laku dengan amat serius.

Kami telah pun memulakan sebuah siasatan rasmi dan sudah mulai berhubung dengan kesemua mereka yang terlibat. Beberapa pekerja yang yang terlibat telah pun mengambil cuti. Kami akan melantik sebuah badan berkecuali untuk membantu kami dalam mengendalikan siasatan ini dengan adil.

Memandangkan siasatan ini sudah bermula, terdapat beberapa batasan-batasan tentang apa yang boleh kami kongsikan semasa proses ini berlangsung. Sehinggalah maklumat-maklumat lain diperoleh, kami berharap untuk tidak membuat apa-apa kenyataan yang mampu menjejaskan proses siasatan dan apa-apa kenyataan yang akan menambahkan lagi tekanan buat pekerja-pekerja kami.

Di sini, kami ingin merujuk kepada emel yang sedang diedarkan, yang mengandungi dakwaan tentang gangguan seksual di BFM 89.9.

Kami di BFM 89.9 amat komited dalam menyediakan suasana persekitaran yang selamat, di mana kami percaya dengan ini ia dapat membantu rakan sekerja dan komuniti kami untuk terus bekerja tanpa perasaan takut, gusar, atau gelisah tentang apa-apa risiko gangguan seksual.

Buat masa ini, kami masih lagi belum dapat mengesahkan lagi apa-apa situasi yang telah dirujuk.

Kami mengambil semua dakwaan gangguan seksual dan salah laku dengan amat serius. Siasatan di peringkat dalaman akan sentiasa diambil apabila apa-apa dakwaan seumpamanya dibawa kepada perhatian kami. Rentetan itu, kami telah melancarkan siasatan dalaman bagi menangani dakwaan-dakwaan yang telah timbul. Kami sentiasa berusaha memberikan ruang pertimbangan yang adil dan wajar buat para pekerja kami, dan kami sentiasa mengambil tindakan di atas apa-apa perilaku yang tidak wajar.

Sebagai langkah berhati-hati juga, kami turut meninjau kembali sistem laporan kami bagi terus memastikan adanya saluran selamat bagi perkara-perkara seumpama ini untuk terus dilaporkan dan diambil tindakan. Kami juga akan terus-terusan mencari jalan bagi menambahbaik kawasan tempat kerja, bagi menyokong dan melindungi mana-mana entiti yang datang kedepan dengan maklumat atau dakwaan tentang apa-apa salahlaku.
